The state mandates counties follow an appeal process granting each town a 15% cushion. We must convince the town that the property is at least 15% over assessed before tax relief is granted. We must file a form (A-1) and pay the state a fee of between $25 and $150 depending on your property’s current assessment. Comparing assessments can’t be used in an appeal; only comparison of “recent sales” are allowed. A recent sale starts at October 1st of the tax year and goes back 12 months. The state maintains 33 “Nonusable Categories” for property sales. Sales designated by the town to be in these 33 categories can’t be used as comparables in an appeal. Tax appeal cases that are rejected by the county tax board can appeal to NJ tax court (or can go directly to state tax court if the assessment exceeds one million dollars) – NJ tax court is a more rigorous legal hearing process than the county tax board.
